    Eleven Notices and One Exchange

    The Securities and Exchange Commission (SEC) of Thailand issued 11 separate notifications to build the framework, and the scope is narrow by design. Bitcoin (BTC) and ether (ETH) are the only crypto assets eligible in the first phase, although the regulator kept the discretion to widen the list later.

    Every fund has to be passive and must track a single crypto asset and keep at least 80% net exposure to it on average across each fiscal year. Moreover, coins must sit with digital-asset custodians supervised by the SEC, and the products can trade only on the Stock Exchange of Thailand (SET). There is no second venue and no over-the-counter workaround.

    Lastly, asset managers are not cleared to launch just because the rules take effect, because each manager still needs SEC approval for its product, so Oct. 16 is the day the gate opens, not necessarily the first trading day.

    Who Gets in and Who Gets Turned Away

    Investor protections are strict as Thai brokers can’t offer margin for crypto ETF purchases, and every buyer must receive an explanation of the product’s structure and risks and confirm they understand it before trading.

    The bigger, more overarching narrative is what the rules keep out:

    • Thai securities firms are still barred from helping retail clients buy overseas crypto ETFs, an exemption reserved for institutions and ultra-high-net-worth investors.
    • Depositary receipts tied to foreign crypto ETFs are also prohibited for now.

    In plain terms, a retail investor in Bangkok who wants a regulated bitcoin fund will be steered toward a Thai-listed product instead of a U.S. one. Domestic mutual funds and private funds also get a new door and can now invest in locally established crypto ETFs, subject to existing investment limits, which could give the new products a base of institutional demand from day one.

    That said, none of this was a surprise as the SEC put the draft rules out for consultation in late August and gave the industry until Sept. 20 to respond. The final version kept the core design almost entirely intact.

    A Market That Needs the Help

    Despite these developments, the local crypto market is shrinking. Data from the Thai SEC, compiled in August, showed active exchange accounts fell to 121,000 in July 2026. That was down 21.82% in a single month and down from roughly 265,000 in 2024. Daily trading value slid 27.13% month over month to 1,378 million baht.

    The same data showed what Thai traders actually use exchanges for, i.e. stablecoins made up 66% of trading volume against 16% for bitcoin, which suggests the venues work more as a dollar bridge than as a place to build long-term crypto positions.

    Consequently, a fund wrapper on the main stock exchange is the regulator’s attempt to pull that activity into a familiar, supervised product.

    Lastly, one can see that Thailand is opening its doors during a rough week, especially as bitcoin’s price dropped below $81,000 on Oct. 8 while liquidations topped $1.1 billion. Moreover, U.S. spot bitcoin ETFs had just logged a $487 million outflow day, their heaviest daily exit since June.
